Prosecution — Judge alone trial — injuring with intent to injure — assault with a blunt weapon — beyond reasonable doubt — self-defence — domestic violence — Crimes Act 1961 ss 66, 189, 193 & 202. The defendant was jointly charged with her son, who had already pleaded guilty, to assaulting the complainant using a metal rod and a vehicle jack. The defendant, her son, and the complainant had conflicting stories about the violence and who was at fault. However, the assault was captured on CCTV. After hearing the testimony of the defendant, complainant, police and others, and having reviewed the CCTV footage, the Judge found this was not a case of self defence and concluded charges were proven beyond a reasonable doubt. Judgment Date: 31 January 2019.
