McBride v BB [2019] NZFC 2596

Published 26 June 2019

Compulsory treatment order — alcohol addiction — choice of treatment facility — cost of treatment — Substance Addiction (Compulsory Assessment and Treatment) Act 2017, s 32. This hearing concerned the treatment arrangements for the subject person, BB. A Compulsory Treatment Certificate had been signed the day prior, as BB recognised that compulsory help in treating an alcohol addiction was needed. The main issue for the Judge to determine was which facility the treatment was to occur at. BB wanted to be treated at Red Door in Wellington while the medical professionals believed BB's interests would be best served by treatment at Nova, the only treatment centre under the Substance Addiction (Compulsory Assessment and Treatment) Act ("the Act"). There were several issues with sending BB to Red Door: it was a private and optional treatment facility and it would cost BB upwards of $30,000. Nova would be free and compulsory but it was in a city far from BB's home where BB had previously had bad experiences. The medical professionals had given evidence of the holistic rehabilitation tools available. The Judge found it was in BB's best interests to go to Nova. An order under s 32 of the Act was made for 56 days of compulsory treatment. Following this, either an extension order or transition plan would be made to help BB adjust back to her home city.
