New Zealand Police v Christina Warren [2016] NZDC 17107

Published 10 October 2016

Theft — rangatiratanga — Maori sovereignty — jurisdiction of the Court. The Court determined that it had jurisdiction in relation to a charge of theft, after considering submissions by the defendant’s McKenzie friend based on Rangatiratanga or Maori sovereignty. The grounds for the submissions were described by the Court, although it was bound by decisions of the higher courts determining that such arguments could not be relied upon. Further, it was said that this was not the appropriate forum for such important matters to be discussed. The Judge determined the Court had jurisdiction to hear the criminal charge against the defendant under the laws of Parliament. Judgment Date: 2 March 2016
