Child abducted to New Zealand — Care of Children Act 2004, ss 105 and 106 — Hague Convention on the Civil Aspects of International Child Abduction. Jurisdictional matters having been made out under s 105, the Judge was tasked with determining whether the father had consented or acquiesced to the child's abduction to New Zealand (s 106). Neither of these grounds was proven on the balance of probabilities, but regardless the Judge would have ordered the child's return for a number of reasons.
