Safety hearing — unsupervised contact — history of domestic violence — welfare and best interests of children — Care of Children Act 2004, ss 5(a), 5A and 46G. This hearing considered whether children would be safe in the unsupervised care of their father given the backdrop of domestic violence. Determined that the children would be safe in their father’s unsupervised care; children’s welfare and best interests having been considered (s 5). The father had successfully engaged with counselling programs and was assessed at supervised contact visits as being caring and engaged. Importantly, the children did not appear fearful and expressed no major concerns to their lawyer.
