Day-to-day care — final parenting order — guardianship order — exposure to domestic violence — Care of Children Act 2004, s 5(a) — Kacem v Bashir [2010] NZSC 112, [2011] 2 NZLR 1. Final order made for grandparents to have day-to-day care and be appointed additional guardians of the children. Supervised contact arrangements made for parents. Children had been exposed to ongoing psychological abuse through exposure to parental violence. Section 5(a) was determinative (Kacem v Bashir cited) meaning that other principles relating to the children’s welfare and best interests (s 5) were to obtain less weight because of the overarching need to ensure safety for the children against exposure to domestic violence.Judgment Date: 26 April 2016. * * * Note: names have been changed to comply with legal requirements. * * *
