Application that lawyer for child be dismissed — role of lawyer for child — Family Courts Act 1980, s 9B — Lawyer for Child Best Practice Guidelines — Care of Children Act 2004. Mother’s application to dismiss lawyer for child dismissed; no prejudice, conflict of interest or issue with safety assessment existed. Lawyer for child to continue in her role. She had complied with relevant legislation (FCA, s 9B) and the Lawyer for Child Best Practice Guidelines. There is no requirement that lawyer for child should be impartial as between parents. As is appropriate, Lawyer for child considers the actions and attitudes of each parent in light of their assessment of the welfare and best interests of the child. Lawyer for child owes no obligation to either parent, their only obligation is to the child they act for.
