Division of relationship property — satisfaction of personal debt — dissipation of relationship property after separation — Property (Relationships) Act 1976, ss 18C, 20 and 20E. It was determined that a loan made to the parties by the applicant's father was not interest bearing as there was a lack of evidence to support that submission. The respondent's student loan was found to be a personal debt (s 20), and as it was satisfied out of relationship property compensation awarded under s 20E was ordered. The applicant's claim for compensation for dissipation of relationship property after separation was declined (s 18C), as the value of the property in question had not been deliberately diminished. Adjustments were made for post-separation contributions, and a further hearing would be required to determine remaining matters regarding the family home.
