Reserved decision — judgment should be set aside — District Court Rules 2014. Mr and Mrs Withers engaged Mr Chandler to undertake building work. Mr Chandler believed that the job was done on time and on budget and that Mr Withers broke the contract in a number of ways. A judgment was made in favour of the Withers Family Trust and quantum was ordered. The issue for the court in this application was whether the judgment should be set aside. As Mr Chandler did not take any steps in the proceeding, this court considered that there has not been a miscarriage of justice. The application was declined. Judgment Date: 12 June 2017
