Causing harm by posting a digital communication — excess breath alcohol — careless driving — Harmful Digital Communications Act 2015 — Summary Offences Act 1981. The defendant and the victim had been a relationship during which, the victim had sent photographs to the defendant in various stages of undress. Following the relationship breakdown, the defendant threatened to post the photos online if she kept contacting the defendant. The defendant proceeded to post three images of the victim on a Facebook page advertising to sell her for $1. The court noted that Parliament passed the legislation to ensure that online communication is done with respect and not in any way be abusive or derogatory. An uplift was given for other charges faced. The defendant received a discount for his youth and guilty plea and was sentenced to a total of nine months imprisonment. Judgment Date: 4 August 2017
