Saldana v Pio [2017] NZDC 18134

Vehicle ownership — Sale of Goods Act 1908, s 25 — Policing Act 2008, ss 8 & 40. The first respondent lent his car to a man trying to become settled in New Zealand. When the first respondent travelled overseas the man transferred the ownership of the vehicle to another person and left the country. The vehicle was eventually seized by police. The person who was last in possession of the vehicle gave no explanation as to how he became the registered owner of the vehicle. The court found that the vehicle was not obtained in good faith and should be returned to the original owner. Judgment Date: 16 August 2017
