Statement of claim — costs — damage to transformer power pole — negligence — District Courts Act 1947, s 62B. The plaintiff sought to recover the costs of repair to a transformer power pole after the defendants vehicle collided with the pole causing damage. The plaintiff also sought interest in accordance with an invoice sent to defendant. Judgment was entered in favour of the plaintiff, and the defendant was ordered to pay the total costs of $19,805.02 for replacement and repairs of the power pole. The Court considered interest and other costs claimed in the invoice were not recoverable, however interest was payable in accordance with the District Courts Act 1947, s 67B of 5 per cent and costs of $1599.
