Breach of Education Act — operating a childcare centre without a licence — sentencing — Education Act 1989, s 317. The defendant company had pleaded guilty to two charges of operating an early childhood education and care centre without holding a current licence. Aggravating features included the company's continued operation after being notified of the illegal operation and the duration of the offending. The court took a starting point of a $200 fine per day that the childhood centre was open without a licence and applied a small discount for previous good character and guilty plea. The defendant company was fined $3,500 on the first charge and $1,750 on the second charge resulting in a total fine of $5,250. Judgment Date: 6 October 2017
