Aggravated robbery — kidnapping — robbery — receiving — sentencing — R v Mako  2 NZLR 170 (CA).
The defendant was sentenced on four charges including robbery and kidnapping in offending which the court noted appeared to be motivated by hostility towards the four victims because of their Asian ethnicity. The offending occurred a period of one week, involved violence to the head and a degree of premeditation. The court also took into account the defendant's previous relevant convictions including four for dishonesty related offending. From a starting point based on the lead charge of kidnapping an uplift was given for the other offending. The defendant was given a reduction in sentence to account for his guilty pleas, the restricted bail conditions he was on and remorse. The defendant was sentenced to five years and three months' imprisonment.
