Published 18 May 2017
Driving whilst disqualified — theft — breach of protection order — careless use of a motor vehicle — breach of bail — breach of community detention — sentencing. The defendant was originally sentenced to intensive supervision, community work and community detention. Upon new noncompliance and subsequent offending the defendant was sentenced to 2 years and 8 months imprisonment. In sentencing, the court reduced the sentence having regard to the totality principle and the fact that the breach of the protection order was the first breach of that order by the defendant. The defendant was disqualified from driving for one year and one day.
