Testamentary promises and family protection claim — Family Protection Act 1955. Following a settlement conference, trust funds were to be applied to buy the deceased’s wife a home on the condition that she would maintain the property and meet outgoings. Cash assets of the estate were divided, with $345,000 going to the widow and $320,000 split between the adult children, adjusted to any remaining surplus after expenses. **Note: names have been changed to comply with legal requirements.
