Sentencing — rape — Band 4 sexual offending — child sex register — R v AM [2010] NZCA 114, [2010] 2 NZLR 750. The defendant appeared for sentencing facing a total of 28 charges relating to sexual offending against two young girls, initially under 16. The defendant pleaded guilty to the charges, which included charges of rape and representative rape. The defendant took up residence in a household and subsequently, over several years, sexually offended against two young sisters. The offending was occasionally accompanied by physical violence, including being threatened with a machete which led to the official complaint. One of the victims became pregnant to the defendant. The defendant did not accept that he had done anything wrong. The Judge deemed the offending fell into band 4 of R v AM and fixed a starting point of 17 years' imprisonment. The Judge granted a four year discount for his guilty plea, bringing the end sentence to 13 years' imprisonment on the rape charge. All other charges were to be served concurrently. The defendant was put on the child sex register and had his name suppressed in the interest of the victims.
