Fit and proper person — appeal — Land Transport Act 1998, s 106. A s 106 appeal was dismissed as the appellant was not a fit and proper person to be the holder of a passenger endorsement or a vehicle recovery endorsement. The conduct which resulted in this finding was consensual sexual activity with a taxi passenger. Relevant case law was considered before the decision of the NZTA was confirmed. The appellant would be disqualified and prohibited from driving any vehicle being used in a transport service with revocation of endorsements for three years. Judgment Date: 23 June 2016.
