Costs award — whether indemnity costs should be awarded — District Courts Rules 2014, rr 14.6 and 15.20 — Bradbury v Westpac Banking Corp [2009] 3 NZLR 400 (CA) — North Shore City Council v Local Government Commission and Independent Devonport Society (Inc) (1995) 9 PRNZ 182. Case law including "Bradbury" was considered regarding a costs application. Increased costs as sought by the defendant were not justified, but costs on a 2B basis were awarded for two proceedings, one of which was discontinued ("North Shore City Council" referred to). Costs were awarded for a costs application on a 1B basis. Judgment Date: 30 June 2016.
