Appeal against decision — Private Security Personnel and Private Investigators Act 2010, ss 50, 53 and 83 — New Zealand Bill of Rights Act 1990, ss 6, 7 and 27. An appeal against a decision of the Private Security Personnel Licensing Authority to refuse to renew a Certificate of Approval in the Class of Private Investigator was allowed. The matter was referred back to the Licensing Authority to reconsider the whole of the matter in light of this judgment. The primary issue identified related to lack of transparency over which material was taken into account in making the decision (s 27). The Judge also questioned the meaning of determination "on the papers" (s 50), and suggested the Authority provide the opportunity of an oral hearing. Judgment Date: 2 November 2016.
