Dismissing or staying all or part of proceeding — District Courts Rules 2014, r 15.1. The defendant’s statement of defence and counterclaim were struck out. The Judge was satisfied that under the Rules there was no reasonably arguable defence in the pleadings. It was pointed out that the claim filed by the Council for outstanding rates said to be $7098.34 was a distinct issue. If the defendant wished to make a claim for negligence or other action of the Council, a new document would need to be filed.
