Application for summary judgment — District Courts Rules 2014, r 12.2. Summary judgment was sought for a breach of contract involving design work for building strengthening. The Judge determined that although the plaintiff had a strong case, there were issues which needed to be determined by cross examination or expert evidence meaning summary judgment could not be entered. Costs were reserved until the trial outcome. The Judge expressed that the parties should discuss settlement in light of the costs of full trial. Judgment Date: 6 May 2016.
