Property (Relationships) Act 1976 — discovery . These proceedings involved determination of an application for discovery regarding relationship property. The principles for discovery in relationship property proceedings were set out, which included: a robust approach in line with the purposes and principles of the act, not unduly onerous but reasonably necessary at the time sought, and allowing for the Court to order a higher level of discovery where information has, for example, been concealed by a party. The application was declined in relation to the first company, with various documentation ordered to be produced for another, and finally declined again regarding two companies where the Judge required better evidence as to the nature of the applicant’s interest.
