Declaration child in need of care or protection — Children, Young Persons, and Their Families Act 1989 — custody order. A declaration was made stating that the child was in need of care and protection pursuant to s 14(1)(a) and (b) of the Act. The child was placed in the custody of the Chief Executive under s 101 and the pre-existing s 78 custody order was discharged. Whilst plans and reports for these proceedings were being finalised the maternal grandparents made an application for a parenting order under the Care of Children Act. It was opined that further investigation into the possibility of the child being placed back with the birth parents needed to occur before a parenting order was finalised. The Judge directed that the parenting applications were to be consolidated with these proceedings and a review plan was to be filed. **Note: names have been changed to comply with legal requirements.
