Care of Children Act 2004, s 105 and s 106 — Application for return of children — Hague Convention arts 1-15 — International child abduction — JHL v Secretary for Justice [2007] 27 FRNZ 645. The applicant seeks return to the United States of America of his children pursuant to s 105 of the Care of Children Act. One party retained the children in New Zealand contrary to the understanding that the children only travel to New Zealand for a short period of time. On the balance of probabilities one party did not acquiesce to the retention of the children in New Zealand. The Court has ordered that the children be returned to the United States of America.
