Reserved judgment — Child Support Act 1991, ss 103B, 103D & 105 — DSJT v MAFR (FC), North Shore, 4 December 2007. This was an appeal pursuant to s 103B Child Support Act against a order of the Commissioner of Inland Revenue departing from the child support formula assessment which increased the applicants child support payment by $2000. The court made an assessment of the financial situations of both parties as at the time the application is made. The court found that the review officer appeared to base his findings on an undecided event which was inadmissible. Therefore the appeal was successful and the order for increased payment of child support in the sum of $2000 was quashed.
