Application for adoption — surrogate child — special circumstance to made an adoption order without an interim order — Adoption Act 1955, s 5. The applicants sought to adopt a child that was born following a surrogacy agreement with a friend. The child had been in their care since birth and the applicants intended to include the birth mother in the life of the child. The court noted a social worker's report that found that the parents were financially able to support the child and that the child was well cared for and reaching each development milestone. The court found that a final adoption order should be granted, and that, although no interim order had been made, special circumstances existed that made a final order desirable.
