Aggravated robbery — burglary — sentence — R v Mako [2000] 1 NZLR 170 (CA) — Arahanga v R [2014] NZCA 379. The defendant was sentenced for his part in the aggravated robbery of a convenience store and the burglary of three residential properties. The aggravated robbery involved the defendant and two associates entering a convenience store armed with an air rifle, a long knife and a small sledge hammer. The rifle was pointed at the clerk's head by the defendant while his associates took tobacco from a cabinet. Money was also taken from the cash registers. The burglaries each involved entry into residential properties and taking items of value including guitars, laptops and a mountain bike. The court noted that the offending had taken place shortly after the defendant had been released from prison for other burglary offending, and that the defendant's history offending involved a lot of violence and dishonesty offending. Credits were given in acknowledgement of the defendant's age and early guilty plea. The defendant was sentenced to five years' imprisonment, the court declined to impose a minimum period of imprisonment and found that it was not realistic to order reparation.
