Application for declaration of change of sex on birth certificate — female to male — mother applying on behalf of young person — transgender persons' rights — Births, Deaths, Marriages and Relationships Registration Act 1995, s 29. The applicant mother applied for a declaration to change the gender on the birth certificate of her 17-year-old child from female to male. The young person's father had signed an affidavit in support of the application. Medical evidence showed the young person had been undergoing hormone treatment as well as counselling. He had identified as male since he was year 11 at school and was saving for top surgery. Because of the young person's age the Judge considered it important to meet him. This would also give the young person the opportunity to meet the person making the decision about his birth certificate. The young person impressed the Judge as having a clear view about his gender. The Judge was satisfied all criteria under s 29 of the Births, Deaths, Marriages and Relationships Registration Act was met and made a declaration changing the sex listed on his birth certificate to male, as well as a name change.
