Published 18 August 2022

Sentencing — breaching release conditions — theft — intentional damage — wounding with intent to cause grievous bodily harm — breaching bail — R v Taueki [2005] 3 NZLR 372 — R v Peng [2015] NZCA 45. The defendant appeared for sentence after pleading guilty to charges of breaching release conditions, theft, intentional damage, wounding with intent to cause grievous bodily harm, and breaching bail (two). After arguing with a woman, he had stabbed her multiple times. The victim was seriously injured and required hospital treatment. The rest of the charges related to theft of alcohol from a store, smashing car windows with a shovel, and moving house without telling his probation officer. The lead offence of wounding with intent to cause grievous bodily harm was aggravated by use of a knife, causing serious and permanent injury, attack to the head, prolonged and extreme violence, and a vulnerable victim. The start point for sentence was nine years' imprisonment. The Court made reductions for guilty plea, background factors (deprived and violent upbringing), and efforts to rehabilitate. The final sentence for the wounding charge was five years five months' imprisonment, with a one-month concurrent sentence for all the other charges. Judgment Date: 13 April 2021
