Sentencing — assaulting a child — kidnapping — assault in a family relationship — assault with intent to injure — breach of a protection order. The defendant was for sentence on charges of assaulting a child, kidnapping, assault in a family relationship (two), assault with intent to injure, and breach of a protection order. The victims were the defendant's sometime-partner and her young son. The defendant had forced his way into the victim's house late at night while intoxicated. He then began to loudly abuse and threaten to kill the victim, and then went into her son's bedroom and continued to make threats and abuse. The defendant prevented the victim and her son from leaving the room and physically assaulted them both, before eventually leaving. The Court set a start point for sentence of 39 months' imprisonment, and allowed reductions for guilty plea, background factors and remorse. The Court considered a home detention sentence to be inappropriate, and imposed a final sentence of 23 months' imprisonment. Judgment Date: 20 June 2022
