Sentencing — wounding with intent to cause grievous bodily harm — stabbing — R v Taueki [2005] 3 NZLR 372 (CA). This was a sentencing for an assault. The defendant stabbed the victim in the abdomen and kicked the victim in the head. This caused serious injuries such as a organ damage affecting the victims' life as he had to undergo years of rehabilitation and medication. A s 27 cultural report was considered, it showed the defendant was exposed to gangs and violence at an early stage; this lessened the sentence. There was some allowance for the defendant's young age. Aggravating factors included the life threatening injuries of the victim and the serious effects it had on his support networks. The defendant did not express interest in leaving the gang and his drug addiction remained untreated. The Judge sentenced the defendant to five years and four months' imprisonment.
