Appeal — revocation of firearms licence — fit and proper person — Arms Act 1983, s 1A, 24(1), 24A & 27(2) — Barrett v Police [2022] NZDC 9189 — Moosman v Police [2021] NZDC 23700 — Z v R [2012] NZCA 607. The appellant sought to overturn a decision by the police to revoke his firearms licence, on the grounds that he was not a fit and proper person. The police had revoked the licence after the appellant was convicted on charges of meeting a young person for sex following grooming, and supplying alcohol to a minor. The Court observed that the offending was serious, but that it did not automatically disqualify the appellant from holding a firearms licence. The appellant had been a first-time offender, had pleaded guilty to the charges and had complied with his sentence. He had the support of his family, who would have made efforts to correct the poor decision-making and attitudes that had led the appellant to offend. The Court found that the appellant was of good character, and the appeal was allowed. Judgment Date: 17 August 2022
