Dispute between guardians — secondary schooling — te reo immersion — kura kaupapa — welfare and best interests — child's views — Care of Children Act 2004, s 46R. This hearing was to determine a dispute around the secondary schooling of the parties' child. The child had been in te reo immersion schooling since pre-school and was currently in a kura kaupapa school at intermediate level. The Court had previously ordered the child was to remain in this kura for the remainder of the school year, and directed the parents to reach a resolution as to where the child was to then attend secondary school. The parents had been unable to reach an agreement, including through mediation, so the matter was set down for another hearing before the Court. The Court considered the parents' submissions, as well as the expert witness evidence provided at the previous court hearing, and the child's views.
