Application to enforce relationship property agreement — The Property (Relationships) Act 1976. The Judge ordered that upon payment of $61,870 by the respondent, all shares she held in the parties’ business and the undivided one half share she owned of a property in Blenheim be vested in the applicant. Further, upon payment she was to resign as director of the parties’ business. The applicant was to provide evidence to the respondent of the release of her personal covenants under the specified mortgage from the bank, or if the bank would not release this information, the applicant was to indemnify her of any costs, claims or damages that may arise in respect of the mortgage. The parties married in 1999 and separated in 2010. They had two children together and until their separation operated a business together. After separation they entered into a relationship property agreement; these proceedings related to an application to enforce that agreement, signed January 2011. **Note: names have been changed to comply with legal requirements.
