Breach of contract — building contract — District Court Rules 2014, r 15.9. The plaintiff sought damages from the respondent for breach of contract. The parties had entered into a building contract whereby the respondent was to build several units for the plaintiff. The respondent failed to complete the building work. The plaintiff then contracted another construction company to complete the build. The Judge determined that the defendant had breached the terms of the contract and the plaintiff was therefore entitled to damages. The Judge awarded the plaintiff $49,013 for breach of contract, as well as surveying, insurance, rubbish removal and loss of rent damages. The total amount awarded to the plaintiff was $74,593.17. Judgment Date: 26 July 2022.
