Sentencing — intent to cause grievous bodily harm — prison — R v Taueki [2005] 3 NZLR 372 — Crimes Act 1961. The defendant appeared for sentence having pleaded guilty to a charge of injuring with intent to cause grievous bodily harm. The attack took place in prison. The defendant and two cooffenders attacked the complainant, who suffered multiple blows to the head and was stomped on when he fell down, causing a loss of consciousness. The Judge adopted a starting point of four years' imprisonment based on R v Taueki. A discount was given of 25 per cent for the guilty plea, and further reductions for his age (21 years old) and the fact it was a cumulative sentence, bringing the sentence to two years six months. This sentence was cumulative on the three years and nine months already imposed. Judgment Date: 19 October 2018.
