Sentencing — burglary — attempted burglary — car theft — ram raids — R v Makimae [2017] NZDC 10429 — R v Crombie CRI-2011-092-019593, 4 September 2012 — R v Waikato [2021] NZDC 18385 — R v Ngawhita [2017] NZDC 8890. The defendant was for sentence on 10 charges of burglary, one of attempted burglary and five of car theft. Together with others he had participated in nine burglaries of businesses, as well as another two instances where he and the others had been unable to gain entry to the businesses that they had intended to burgle. Seven of the burglaries were ram raids, where a stolen vehicle was used to gain forcible entry into the targeted premises. The Court estimated that the offending had caused as much as $400,000 worth of property damage, as well as distress to the car owners and the owners and employees of the businesses. The start point for sentence was five and a half years' imprisonment, uplifted by another six months for repeat offending and offending while on home detention. In mitigation the defendant had pleaded guilty, had expressed remorse, was only 18 at the time of offending, and had had a disadvantaged upbringing. The final sentence was three years' imprisonment.
