New Zealand Police v Ruck [2022] NZDC 14828

Published 25 August 2023

Sentencing — threatening to kill — failing to supply identification particulars to police — COVID-19 — global pandemic — extremism — conspiracy theories. The defendant was for sentence on three charges of threatening to kill and one of failing to supply identification particulars to police. He had posted a nine-minute video to YouTube in which he accused the New Zealand government of trying to overthrow the Trump Administration in the US, and then said that he had the right to shoot the then-New Zealand Prime Minister. He later sent an email to 61 recipients in which he threatened to kill anyone involved in mandating COVID-19 vaccinations. The start point for sentence was one year six months' imprisonment. The Court reduced this by two months to recognise the "disproportionately severe" treatment that the defendant had received while on remand in prison. The final sentence was one year four months' imprisonment. Judgment Date: 7 July 2022.
