Sentencing — male assaults female — causing harm by posting a digital communication — Harmful Digital Communications Act 2015. The defendant appeared for sentence on one charge of male assaults female and one of causing harm by posting a digital communication. The victim was his ex-partner. During an argument the defendant had pushed and poked the victim, thrown garden waste at her and spat at her. He had then given her new partner a USB stick containing intimate images of her and threatened to distribute the images to her workplace and post them on social media. The Court determined that a sentence of community detention would be appropriate, as it would serve to denounce the defendant's conduct and act as a deterrent, while also allowing him to retain his employment. The Court imposed a sentence of five months' community detention and ordered an emotional harm payment of $1000 to the victim. Judgment Date: 29 May 2018.
