Kingi v Rata [2016] NZFC 1536 Parenting order — Care of Children Act 2004, s 5 .A parenting order was made for the child to be in the day-to-day care of his mother following a contested hearing where the child’s aunt sought the continuation of a shared care arrangement. The child had been exposed to domestic violence in the mother’s previous relationship during a crucial zero to three years of age development period, and Child, Youth and Family services were involved. At the time of the decision the child had been living in a 50/50 care arrangement with his mother and his aunt, although the mother was intending to relocate. The Judge weighed up the principles set out in s 5 of the Act and determined that it was in the child’s best interests for the parenting order to be made in favour of the mother. **Note: names have been changed to comply with legal requirements.
