Sentencing — indecent act on a child — representative charges — Child Protection (Child Sex Offender Government Agency Registration) Act 2016 — Sentencing Act 2002, s 9 — R v Paki [2012] NZHC 3494 — O v R (CA/542/2009) — McKelvey v Police HC Palmerston North, CRI-2004-454-69, 24 September 2004 — Shaw v R [2014] NZCA 322 — E (CA689/10) v R [2011] NZCA 13, (2011) 25 CRNZ 411. The defendant appeared for sentence on six charges of doing an indecent act on a child after being found guilty by a jury. Over an 18 month period he sexually abused two children while looking after them. With reference to case law the Judge adopted a starting sentence of three and half years' imprisonment. There were no factors warranting an uplift, but due to similar offending in 1991 the defendant could not claim he was of good character. A modest discount of three months was given for difficulties in the defendant's life. The end sentence was three years and three months' imprisonment and the defendant was registered on the Child Sex Offender Register. Judgment Date: 14 January 2020.
