Sentencing — doing an indecent act on a child — name suppression — Criminal Procedure Act 2011, s 200. The defendant was to be sentenced on a single representative charge of doing an indecent act on a child. The offending came about when the defendant met the victim at the school where the defendant was a teacher and the victim was a student. They formed a relationship which gradually became inappropriate, involving them exchanging overly-familiar greetings, around 2000 photographs, and intimate hugs including a "lover's cuddle". A sentencing indication had shown a start point of three years' imprisonment. The Court made reductions for pleas and prior good character, but declined to make a discount for remorse, considering that the defendant had not taken full responsibility for the offending. The final sentence was 11 months' home detention. The Court declined to allow the defendant name suppression, finding that there would be no extreme hardship to the defendant or her family.
