R v Tamai [2020] NZDC 11360

The defendant appeared for sentence on 26 charges involving possession and supply of methamphetamine and unlawful possession of firearms. He had acted as the middleman in a drug-selling ring in Rotorua, receiving methamphetamine from suppliers and on-selling it. The Court had previously given a sentencing indication with nine and a half years' imprisonment as the start point: eight years for the methamphetamine offending and an 18-month uplift for the firearms. The Court reached this figure by taking account of the large amount of methamphetamine involved (260 grams), the significant size of the commercial operation, and the involvement of gang members. A s 27 report outlined the defendant's efforts at rehabilitation, for which the Court allowed a one-year discount. With another discount for guilty plea, the final sentence was six years four months' imprisonment. Judgment Date: 18 June 2020.
