Sentencing — indecent assault on a boy under 16 — indecent assault on a boy under 14 — R v Morris [2020] NZHC 1662. The defendant appeared for sentence on five charges of indecent assault on a boy under 16, and one of indecent assault on a boy under 14. Two of the charges were representative. There were six victims, and the offending occurred over two decades at a school where the defendant was a teacher and the victims were students. The defendant had said that sex offending against students was normalised at the school at the time, but the Court stated that this did not mitigate what the defendant had done. The offending was aggravated by planning and premeditation, vulnerable victims, breach of trust, and major impact on the victims. The start point for sentence was seven years' imprisonment, which the Court reduced to six and a half years as the least restrictive outcome. In mitigation, the defendant had shown remorse, had pleaded guilty and was of an advanced age and poor health. The final sentence was three years seven months' imprisonment.
