Adoption — overseas adoption — Adoption Act 1955, ss 3, 11 and 17 — Tongan Guardianship Act 2004, s 6 — Adoption (Intercountry) Act 1997. A s 11 interim adoption order was made in the applicants' favour. The children had undergone a customary Tongan adoption under the Tongan Guardianship Act, the effect of which was to transfer the parenting rights of the birth parents to the applicants. That process was relevant background information in determining whether to grant an order. It was determined that the applicants, as well as being fit and proper people, had a genuine desire to reunite with the children who they viewed as their family and the children themselves had a similar view.
