Child support — jurisdiction — discharge registration order — maintenance — Family Proceedings Act 1980. This was an application to discharge a registration order for the applicant to pay child support for his two boys. The order was made in Canada and it was registered in New Zealand where it was treated as a child support order. The order was for the applicant to pay $216.06 per month until the boys reached 18 years old; at the time of the proceedings, they were over 18. The applicant submitted that he was double charged as while he was paying child support in Canada he had accrued arrears in New Zealand. The child support owed in New Zealand amounted to around $18,000. The Court had no jurisdiction over the order made in Canada but had jurisdiction over the New Zealand registration order. The Court discharged the New Zealand registration order, and the amount owed was set aside. Judgment Date: 23 September 2022.
