Tenancy Tribunal Appeal — declined re-hearing — boarding house — Residential Tenancies Act 1986, ss 5 & 117 — District Court Rules 2014, r 11.24. The plaintiff appealed a Tenancy Tribunal decision declining a re-hearing following a decision ordering her to pay $480 in damages to two tenants. The appeal was of the decision to refuse a re-hearing as the amount involved on appeal was less than $1,000, as provided by s 117 of the Residential Tenancies Act. The appellant's claims included: the Adjudicator pre-determined the matter, the Tribunal lacked jurisdiction and was wrong in law; and there had been a miscarriage of justice. The Judge held that no miscarriage of justice had been identified and that the appellant had not established any of her other claims. Accordingly, the appeal was dismissed. Judgment Date: 28 June 2019.
