Application for access to court file — summary of facts — unendorsed summary. The Maritime Union of New Zealand applied for access to the summary of facts prior to the sentencing of the defendant port company. The grounds for the application were to identify any potential victims who may be entitled to reparation. The defendant opposed the application and the prosecution opposed unrestricted access but not access for the stated purpose only. Ordinarily the application would be granted on the stated grounds, but in this case certain steps had not been followed which resulted in the summary of facts not being certified by the Judge. Absent this it was not appropriate to grant access to the summary to entities other than the parties to the proceeding. The application was declined. Judgment Date: 30 November 2020.
