Appeal against decision — Tenancy Tribunal — non-appearance of appellant — stay of enforcement — dismissal — costs. This was an appeal against a decision of the Tenancy Tribunal. A stay of enforcement had been granted pending the outcome of the appeal. There was no appearance by or for the appellant, despite repeated phonecalls. The Judge was satisfied that the appellant had been notified of the time and date of the hearing as well as the stay of enforcement. The Judge dismissed the appeal on the basis of non-appearance, noting that the order of the Tribunal was now enforceable. The respondents, having been successful in the appeal, were to file and serve a costs application within 10 days of the hearing date if they decided to seek costs against the appellant. Judgment Date: 1 October 2020.
